These Million Dollar Match Program Terms of Service (“MDM Terms”) govern your participation in the Million Dollar Match Program (“Program”). These MDM Terms form a part of the Fanstake Fan’s Terms of Service (“Fan’s Terms”) which are incorporated herein and made a part hereof. Unless the context requires otherwise, all capitalized terms used, but not defined here, shall have the meanings set for in the Fan’s Terms. By participating in the Program, you agree to these MDM Terms.

1.  Million Dollar Match Overview.
Fanstake is offering a promotion wherein Fanstake will provide up to $1,000,000 in matching funds to eligible Transfer Stakes (as defined below) (“Million Dollar Match”).

2. Eligibility
2.1 This Program is only valid for Transfer Stakes. A “Transfer Stake” is defined as Stake made to recruit a Selected Athlete currently on another college roster to join the fan’s associated team’s roster in the successive season.

2.2 Any attempt to misuse or manipulate the Program may result in disqualification from the Program and forfeiture of all Matching Funds (as defined in Section 3).

3. Matching Funds‍
3.1 Fanstake will match up to $100 per fan for any number of Transfer Stakes (such matching funds, the “Matching Funds”).

3.2 Transfer Stakes offer a 2x multiple of the Transfer Stake amount (e.g., $10 Transfer Stake amount x2 = $20. Fanstake’s Matching Funds = $10).

3.3 The maximum Matching Funds amount per individual Selected Athlete under the Program is $25,000.

4. Transfer Stake Conversion
4.1 If the Selected Athlete selects the school associated with your Transfer Stake by making a public announcement of their school choice or otherwise notifying Fanstake of their choice (“Formal School Selection”), Fanstake will endeavor to enter into an NIL Contract with the Selected Athlete to endorse Fanstake. Both the Matching Funds and the Transfer Stake will be applied to the available endorsement dollars for the Selected Athlete in accordance with Fanstake’s NIL Contract policies.

4.2 If the Selected Athlete does not choose the school associated with your Transfer Stake, Fanstake will credit the full Transfer Stake amount to your Account within ten (10) days of the Selected Athlete’s Formal School Selection and the Matching Funds will expire and are not eligible for future use on the Platform or otherwise. You can apply the amount credited to your Account to another Stake associated with another Selected Athlete.

4.3 If the Selected Athlete selects the school associated with your Transfer Stake but chooses not to enter into an NIL Contract with Fanstake, Fanstake will still credit the full Transfer Staked amount to your Account within ten (10) days of the latter of: 1) the Selected Athlete’s rejection of the NIL Contract or 2) Fanstake’s determination that the Selected Athlete will not enter into an NIL Contract. Matching Funds will expire and are not eligible for future use on the Platform or otherwise. You will be notified of these events, as applicable, on your Fanstake dashboard. You can apply the credited amount to another Stake associated with another Selected Athlete.

5. Liability
Fanstake is not liable for any damages, losses, or legal issues arising from participation in the Program.

6. Termination and Suspension
Fanstake may modify, suspend, or terminate the Program at any time in our sole discretion and without prior notice.
